The transposition of RED II Directive into the National Legislation and operating model for the PPA electronic board

Prepared by Energy Team

As anticipated in our previous Newsletter, Legislative Decree no. 199/2021 on “Implementation of Directive 2018/2001/EU of the European Parliament and of the Council of 11 December 2018 on the promotion of the use of energy from renewable sources” (the “Decree“), which entered into force last December 15, introduced some provisions related to the development of Power Purchase Agreements (“PPAs“).

In particular, the Decree has provided, in art. 28 paragraph 1, that within 180 days from its entry into force the Gestore dei Mercati Energetici – GME S.p.A. (“GME“), in order to ensure a gradual implementation of the PPAs negotiations, will realize an electronic board with the aim of promoting the match between the parties potentially interested in the execution of such agreements.

In this regard, it should be noted that the GME published for consultation purposes a document (Contrattazioni di lungo termine di energia rinnovabile – Proposta per l’introduzione della Bacheca PPA) to allow stakeholders to make observations no later than January 21, 2022 on the proposed model of operation of the PPAs notice board.

Updates will follow when the consultation deadline will expire.

The Energy team is available for any clarification.
