Published in the Official Gazette the “Cohesion Decree”: new bonuses for hiring certain categories of workers and main news for the Italian labor market

On May 7th, the Decree-Law No. 60/2024 (hereinafter "the Decree" or "Cohesion Decree") called "Additional urgent provisions on cohesion policies" was published in the Official Gazette. The main changes regarding subsidized hiring of employees as well as further interventions pertaining to the labor market are outlined below are highlighted.

Italian tax authorities’ reply to the Ruling request no. 83/2024 – The provision of Litigation Finance or Third Party Litigation Funding’s services are VAT exempt 

With the Reply to the Ruling request no. 83 of March 28, 2024, the Italian Tax Authorities provided some clarifications regarding the VAT treatment of Litigation Finance or Third Party Litigation Funding operations, recognising that they can be qualified as service provisions of a financial nature, exempt from VAT, under Article 10, first paragraph, no. 1), of the Presidential Decree no. 633/1972. 

Social Security Agreement between Italy and Japan become effective from April 1st, 2024

After years of awaiting, the Agreement on Social Security signed between Italy and Japan (hereafter the “Agreement”) finally and fully enters into force, allowing the enhancement not only of commercial trades but also of know-how between the two countries. Beyond that, the main benefit of this deal will be to exempt posted workers to and from Japan from social security contribution obligations in the country where the work is being carried out - by de facto - ceasing the double social security taxation applied up to now by reducing the labor costs of posted personnel.

Signed the renewal of the collective agreement for the tertiary, distribution, and services sector

On March 22, 2024, u.s. Confcommercio, Filcams Cgil, Fisascat Cisl and Uiltucs Uil (hereinafter “the Parties”), signed the agreement for the renewal of the National Collective Labour Agreements (NCLA) Commerce, for employees of Tertiary, Commerce, Distribution, and Services Confcommercio companies that expired on 31/07/ 2019. This renewal is particularly important as it covers more than 2 million workers.

MICAR Regulation: progress on the elaboration of technical standards and guidelines

On March 25, 2024, the European Securities and Markets Authority (ESMA) published two documents under the so-called Market in Crypto-Assets Regulation (MiCA Regulation) i.e. Regulation (EU) 2023/1114 of the European Parliament and of the Council of May 31, 2023, and published in the Official Journal of the European Union on June 9, 2023.
